Privacy Policy

Welcome to PhotoHala. PhotoHala provides a quick and fun way to it's users to share Photos/Videos within PhotoHala or to other content-sharing websites such as Facebook, Tumblr, Twitter and Flickr. You can snap a picture, edit it with advance filters or add a sticker if you like.

  • Our Privacy Policy explains how we collect, use, share and protect information in relation to our mobile services or any software or third party API used in connection with PhotoHala. 

  • By using our Service you understand and agree that we are providing a content-sharing platform for you to post you pictures, videos, comments or any material related to you. This means that other users may search for, see, use, or share any of your User Content that you make publicly available through PhotoHala. Our private policy applies to all kind of users.

1. INFORMATION WE COLLECT

We collect the following types of information.

Information you provide us directly:

  • Your username, password, e-mail address, profile picture when you Sign up from PhotoHala. 

  • Your mobile number when you Sign up via mobile number.

  • Your username, public profile, email, friends, about info, birthdate when you Log in using your Facebook ID.

  • Profile information that you provide for your user profile(e.g first and last name, picture, birthdate and phone number). 

  • Phone number will  not visible to other users using the application and is specifically for easy Log in access to PhotoHala. Your birthday will also  not be visible to other users. However  your username can be searched by other users to follow you on PhotoHala.

  • User content related to PhotoHala that you agreed to share.(e.g. photos, videos, comments, tags, places, address and all other material) that you post or add to PhotoHala.​

  • Communication between you and PhotoHala. For example, we may send you Service-related emails (e.g., account verification, changes/updates to features of the Service, technical and security notices). Note you may not be opt out of Service-related e-mails.

Friend suggestions:

 

  •  Your profile information and related content will be displayed to other users so that they can follow you if they like. Similarly you are also shown PhotoHala user information through suggestions.

​Finding friends on PhotoHala.

  • You can search friends and send them invite in many different ways. You can search friends by their username, places and tags. Using places and tags you are shown relative content of other users. It depends on you that you wanted to share, like, dislike that content or you want to follow particular user.

  • If you choose to find your friends through your device's contact list, then PhotoHala will access your contact list to determine whether or not someone associated with your contact is using PhotoHala.

  • If you choose to invite someone to the Service through our "invite friends" feature, you may select a person directly from facebook contacts list on your device and send them invitation to use PhotoHala.

Note: You are fully responsible for the kind of content you share with other users on PhotoHala. You understand and agree that any information shared by you on PhotoHala is your responsibility and if the information/content shared by ugoes to wrong hands, PhotoHala is not responsible. PhotoHala is only responsible for information, you do not share with other users. Once related content regarding you are on PhotoHala, it become public. 

Metadata: 

  • Metadata is usually technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.

  • Users can add or may have Metadata added to their User Content including a hashtag (e.g., to mark keywords when you post a photo), geotag (e.g., to mark your location to a photo), comments or other data. This makes your User Content more searchable by others and more interactive. If you geotag your photo or tag your photo using other's APIs then, your latitude and longitude will be stored with the photo and searchable (e.g., through a location or map feature) if your photo is made public by you in accordance with your privacy settings.

2. SHARING YOUR INFORMATION.

We will not rent or sell your information to third parties outside Instagram (or the group of companies of which Instagram is a part) without your consent, except as noted in this Policy.

What happens in the event of a change of control:

  • If we sell or otherwise transfer part or the whole of Instagram or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, User Content and any other information collected through the Service may be among the items sold or transferred. You will continue to own your User Content. The buyer or transferee will have to honor the commitments we have made in this Privacy Policy.

Responding to legal requests and preventing harm:

  • We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.

  • User account will also be blocked immediately, if requested legally from government investigative authorities .

4. CHILDREN POLICY. 

  • PhotoHala does not knowingly collect or solicit of any information for anyone under age of 13. This service is not intended  for children and any information for the children under 13 would be deleted. 

  • If user does not follow PhotoHala children policy his/her account is blocked permanently soonest and PhotoHala administrators will try to make sure that same user will not create another account.

5. ABUSIVE AND OBJECTIONABLE CONTENT. 

  • Abusive and objectionable content is not tolerated and user account would be blocked immediately by our administrators till further action. The user account can be blocked temporarily or permanently soonest if user is abusive or share objectionable content. There is no tolerance for it. If user agrees that he/she will not share objectionable content again, his/her account will be unblocked. Repeated violations leads to permanent blockage of user from using PhotoHala by our administrator.  It depends on the content and our administrator will decide that user would be blocked permanently or temporarily. Administrator would try to make sure that blocked user could not create account again on PhotoHala with another name, email ID or phone no.
